DNREC Proposes Rule Amendments to Address EPA's SIP Call on Startup, Shutdown and Malfunction Emissions



The Division of Air Quality in the Delaware Department of Natural Resources and Environmental Control (DNREC) is proposing to amend section 7 of the Delaware Administrative Code Regulations 1104, 1105, 1108, 1109, 1114, 1124 and 1142 to address EPA's SIP Call on startup, shutdown, and malfunction (SSM) emissions.  Specifically DNREC is proposing to remove the SSM exemption from these regulations.  In addition, DNREC is updating the averaging periods to specify 30-day rolling averages for the particulate matter emission limits in Regulations 1104 and 1105.  The global warming potentials in Regulation 1125 will also be updated consistent with 40 CFR Part 98 Subpart A.

A public hearing for this rule change is scheduled for October 25, 2016 and comments are also due on October 25, 2016 to David Fees, Delaware DNREC, Division of Air Quality, State Street Commons, 100 West Water Street, Suite 6A, Dover, DE 19904.
