NDEQ Proposed Changes to Title 129



The Nebraska Department of Environmental Quality (NDEQ) has recently completed an internal draft of proposed revisions to the air quality regulations located in Title 129 of the Nebraska Administrative Code. The revisions to Title 129 include changes to NDEQ's procedural public notice requirements as well as a number of revisions to incorporate changes made to federal regulations in the last year including the following:  changes to the New Source Performance Standards (NSPS) and Emissions Guidelines for municipal solid waste landfills (Chapter 18), changes to the National Emission Standards for Hazardous Air Pollutants (NESHAPs) for the wool fiberglass production industry (Chapter 28), reductions in the ozone National Ambient Air Quality Standard (Chapter 4), and changes to the PSD Significant Emissions Rates (SERs) and Significant Impact Levels (SILS) associated with PM2.5 (Chapter 19).

NDEQ plans to post the proposed changes to Title 129 on their website, once the Governor's Policy Review Office has reviewed and approved the changes. Following public release of the changes, NDEQ will host at least one public meeting to review and discuss the updates with anyone interested in attending.
