Proposed Changes to Wyoming Air Quality Standards and Regulations



The Wyoming Environmental Quality Council (EQC) has scheduled a public hearing for November 17, 2016 to consider the following changes to the Wyoming Air Quality Standards and Regulations (WAQSR) proposed by the Wyoming Department of Environmental Quality's (WDEQ) Air Quality Division.  Written comments will be accepted until 5:00 pm MST, November 15, 2016.

The following proposed changes will be considered:

  • Chapter 2.  Ambient Standards
    • Section 2:  Incorporate by reference, revisions to the State Implementation Plan (SIP);
    • Section 6:  Ambient standards for ozone will be updated to incorporate the latest ozone National Ambient Air Quality Standards (NAAQS); and
    • Section 12:  Incorporate by reference, revisions to the State Implementation Plan (SIP).
  • Chapter 3.  General Emissions Standards
    • Section 3:  Emission standards for nitrogen oxides, involve a minor revision correcting an inconsistency regarding internal combustion engines;
    • Section 9:  Minor regions to correct inconsistency of internal combustion engine emission standards for nitrogen oxides; and Incorporate by reference, revisions to the State Implementation Plan (SIP); and
    • Contact information for the Division will also be updated.
  • Chapter 4.  State Performance Standards for Specific Existing Sources
    • Section 6:  Incorporation by reference; and
    • Contact information for the Division will also be updated.
  • Chapter 5.  National Emission Standards
    • Section 2:  Updates to New Source Performance Standards (NSPS) to incorporate by reference, 40 CFR part 60, Subparts OOOO, OOOOa, and TTTT;
    • Section 4:  Incorporation by reference; and
    • Contact information for the Division will also be updated.
  • Chapter 6.  Permitting Requirements
    • Section 3:  Revisions reflecting the Supreme Court's decision in UARG v. EPA, 134 S. Ct. 2427 (2014); and Removal of outdated Federal Register reference in the definition of "tpy CO2 equivalent emissions (CO2e)."
    • Section 4:  Incorporate by reference, revisions to the State Implementation Plan (SIP); and Removal of outdated Federal Register reference in the definition of "tpy CO2 equivalent emissions (CO2e)."
    • Section 7:  Clean air resource allocation expiration updated to include a general reference replacing a direct reference to Chapter III of the Rule of Practice and Procedure of the Department; and
    • Section 14:  Incorporate by reference, revisions to the State Implementation Plan (SIP).
  • Chapter 7.  Monitoring Regulations
    • Section 3:  Revisions reflecting the Supreme Court's decision in UARG v. EPA, 134 S. Ct. 2427 (2014); and Removal of outdated Federal Register reference in the definition of "tpy CO2 equivalent emissions (CO2e)."
  • Chapter 8.  Nonattainment Area Regulations
    • Section 10:  Incorporate by reference, revisions to the State Implementation Plan (SIP).
  • Chapter 11.  National Acid Rain Program
    • Section 2:  Acid Rain Program; and
    • Contact information for the Division will also be updated.
