Summary of Qualifications
Mr. Rubenstein is a Senior Partner with Sierra Research, a Trinity Consultants company, and is based in Sacramento, California. Mr. Rubenstein co-founded Sierra Research in 1981, and has more than 40 years of experience in the air pollution field. He has an extensive background in all aspects of air quality planning, regulatory development, pollution control strategy development and analysis, emission inventory development, emission control system design and evaluation, and automotive emission control design. As manager of Trinity’s Sacramento office, Mr. Rubenstein is principally responsible for Sierra’s activities related to stationary sources. He has supervised the preparation of control technology assessments, environmental impact reports, permit applications for numerous industrial and other development projects throughout the United States, and air quality licensing applications before the California Energy Commission. Other work has included preparation of nonattainment plans; preparation and review of emission inventories and control strategies; preparation of the air quality portions of environmental review documents for controversial transportation, energy, mineral industry, and landfill projects; preparation of screening health risk assessments and supporting analyses; and the development of air quality mitigation programs.
Prior to co-founding Sierra, Mr. Rubenstein was the Deputy Executive Officer for technical programs for the California Air Resources Board (CARB). While at CARB, Mr. Rubenstein supervised the work of more than 300 engineers and scientists involved in the development and enforcement of a wide variety of air pollution control regulations.
Mr. Rubenstein has a Bachelor of Science degree in Engineering from the California Institute of Technology. He is a member of the South Coast Air Quality Management District’s Best Available Control Technology Scientific Review Committee; Past Chair of the Golden West Section and Mother Lode Chapter of the Air & Waste Management Association; and is a Qualified Environmental Professional certified by the Institute for Professional Environmental Practice.
Litigation Support Experience
Mr. Rubenstein has prepared expert reports and testified at deposition in administrative hearings, and at trial, in a number of proceedings related to air quality regulations and compliance matters. In each of those proceedings, he was qualified as an expert witness.
Mr. Rubenstein has presented testimony and served as a technical expert witness before numerous state and local regulatory agencies, including the U.S. Environmental Protection Agency, California State Legislative Committees, the California Air Resources Board, the California Energy Commission, the California Public Utilities Commission, numerous California air pollution control districts, the Connecticut Department of Environmental Protection, the Hawaii Department of Health, and the Alabama Department of Environmental Management. In addition, he has served as a consulting expert to the Alaska Department of Law in a case involving PSD applicability to modifications at an existing industrial stationary source, and as a consulting expert to the California Department of Justice in a variety of air quality matters.
Mr. Rubenstein has extensive experience in providing expert technical services in a number of cases where air quality and public health have been an issue:
- Administrative proceedings (including variance hearings) and enforcement actions involving local, state, and federal regulatory agencies
- Licensing proceedings before local, state, and federal regulatory agencies
- Litigation alleging harm to individuals or property related to air pollutant emissions
- Litigation involving alleged violations of air quality laws or regulations
- Legal challenges to local, state, and federal regulatory programs
In addition to his experience as a testifying expert, Mr. Rubenstein has extensive experience as a consulting expert. This experience includes preparation, review, and critique of expert reports; assistance in the preparation for deposition of opposing technical experts; and preparation and review of trial graphics.
