On September 7, 2016, the Maricopa County Air Quality Department (MCAQD) adopted amendments to MCAQD Rule 241: Minor New Source Review (NSR). MCAQD Rule 241 provides a procedure for the review of new sources and modifications to existing sources of air pollution requiring permits or permit revisions. Amendments to MCAQD Rule 241 include:
- Revising the Best Available Control Technology (BACT) thresholds from 25 tons per year to 40 tons per year for volatile organic compounds (VOCs), nitrogen oxides (NOx) and sulfur dioxide (SO2);
- Revising the Reasonably Achievable Control Technology (RACT) thresholds from 25 tons per year to 40 tons per year for VOCs, NOx and SO2; and
- Various corrections and updates to typographical errors, grammar and format of MCAQD Rule 241.
The revisions to the BACT and RACT thresholds were finalized in order to be consistent with federal thresholds. Additionally, the revisions to the BACT and RACT thresholds eases the regulatory burden on small businesses.
