The Bay Area Air Quality Management District (BAAQMD) has announced the suspension of proposed Regulation 12, Rule 16: Petroleum Refining Greenhouse Gas Emission Limits. The suspended action comes after the state's amendment to Assembly Bill 398 (AB 398), the California Global Warming Solutions Act of 2006, which was signed by Governor Brown on July 25, 2017. AB 398 extends California's Cap-and-Trade program from 2020 to 2030 and specifically prohibits local air districts from adopting rules aimed at reducing carbon dioxide emissions from stationary sources subject to Cap-and-Trade. As such, the BAAQMD's proposed Regulation 12, Rule 16 would have been inconsistent with the newly amended bill, prompting the district to halt further action towards implementation.
