The Bay Area Air Quality Management District (BAAQMD) will hold a public hearing on November 20, 2019 for the Board of Directors to consider adopting the proposed amendments to District Regulation 5: Open Burning (Reg 5), and Regulation 6, Rule 3: Wood Burning Devices (Rule 6-3). The amendments are part of the BAAQMD's Wildfire Air Quality Response Program (WAQRP) to prevent and prepare for responses to wildfire events, which are consistent with statewide initiatives (SB1260 Fire Prevention and Protection: Prescribed Burns, SB901 Wildfires, and Executive Order N-05-19).

The proposed amendments reflect the following updates:

  • Reg 5 would create a limited exemption for public agencies from payment of the open burning fees for prescribed burns intended to prevent wildfires, as well as to clarify definitions and existing standards.
  • Rule 6-3 would allow Spare the Air Alert notifications year-round to alert the public when particulate matter is anticipated to exceed unhealthy levels, announce mandatory burn bans, and clarify definitions and existing standards.

The public hearing will be held at the Bay Area Air Quality Management District's Board Room, 375 Beale Street, San Francisco, California, on November 20, 2019 at 9:30am.
