On August 30th, the Office of Administrative Law approved the adoption of amendments to the Clear and Reasonable Warnings section of the California Code of Regulations. The amendments will repeal all sections of Article 6 (beginning with section 25601) with the exception of the April 2016 emergency rulemaking decision regarding exposure to bisphenol A in canned foods. The repealed sections will be replaced with two new Subarticles to Article 6. The new regulations will update the labeling requirements for the method of transmission and content warnings required in by Proposition 65 Safe Drinking Water and Toxic Enforcement Act of 1986. Facilities must be compliant with the updated requirements by August 30th, 2018, but may choose to comply with the current regulations until that time.
