On May 21, 2018, the EPA finalized its approval of the revisions to Bay Area Air Quality Management District (BAAQMD) Regulation 2, Rules 1, 2, and 4, that were made and submitted in December 2017. These revisions were made in order to correct deficiencies that the EPA had previously identified in these rules. The rules govern the issuance of permits for stationary sources, review and permitting processes for major sources and modifications, and Emission Reduction Credit issuance and banking. A breakdown of the identified rule deficiencies and the revisions incorporated in order to correct them can be found in the Proposed Rule issued by EPA on March 1, 2018.

Effective June 20, 2018, the revised versions of BAAQMD Regulation 2, Rules 1, 2, and 4 will be incorporated into the California State Implementation Plan (SIP), and become federally enforceable. For any questions or more information on the impact of the incorporation of these revised rules into the California SIP, please contact Divya Agarwal at (510) 285-6351.
