The Monterey Bay Air Resources District (MBARD) is proposing to adopt Rule 441 Boilers, Steam Generators, and Process Heaters. Rule 441 will apply to AB617 facilities that operate boilers, steam generators, and process heaters rated more than 2 million British thermal units per hour (MMBtu/hr). Various facilities currently subject to California's Greenhouse Gas (GHG) Cap-and-Trade Program will also be subject to Rule 441.

The Rule will require compliance with new nitrogen oxide (NOx) and carbon monoxide (CO) emission limits, source testing, recordkeeping and test methods.

  • Boilers and process heaters rated between 2 and 5 MMBtu/hr will be required to meet the 30 ppmv NOx emission limit by installing control technology such as low NOx burners
  • Steam generators rated above 2 MMBtu/hr, and boilers and process heaters rated between 5 and 20 MMBTu/hr will be required to meet the 15 ppmv NOx emission limits by installing ultra-low NOx burners or similar technology
  • Boilers and process heaters rated above 20 MMBtu/hr will be required to meet the 9 ppmv NOx emission limit by installing ultra-low NOx burners, selective catalytic reduction or similar technology

The MBARD will host a public workshop on January 15, 2020 at 10:00 am, with board adoption scheduled for February 19, 2020 at 1:30 pm, during which times public participation is welcome. The public hearings will be held at the MBARD Board Room, 3rd Floor, 24580 Silver Cloud Ct., Monterey, CA 93940.
