Cook County passed a new ordinance requiring facilities in suburban Cook County to report and submit fees associated with their annual liquid hazardous waste generation.  This ordinance does not apply to facilities located in the city of Chicago.  All facilities generating liquid hazardous waste are required to submit this report.  Fees of $0.02/gallon must be submitted with the report for any facility generating greater than or equal to 420 gallons during the reporting period.  Liquid hazardous waste is defined per Illinois Environmental Protection Act Section 5/3.475 (i.e., "special waste") that is transported off-site under manifest according to federal Resource Conservation and Recovery Act (RCRA) regulations, but does not include used oil or potentially infectious medical wastes.

Affected facilities should report according to the schedule below.

  • For waste generated during the period from January 1, 2016 through June 30, 2016, the report and fee are due September 1, 2016.
  • For waste generated during the period from July 1, 2016 through December 31, 2016, the report and fee are due March 1, 2017.
  • For waste generated each year after 2016, the reporting period is January – December and report and fee due 90-days after the end of the reporting period (i.e. March 1).

Failure to submit the form and any applicable fees on time may result in penalties up to $10,000.  Additional details can be found on the Cook County website.
