IDNR has determined that emergency engines subject to maintenance requirements and non-emergency engines subject to emission limits under the RICE NESHAP are not eligible to use the small unit exemption (SUE). If the SUE is being used for an engine that is no longer eligible because of the RICE NESHAP, and the engine does not qualify for another permit exemption, a construction permit must be obtained. Facilities should consider what other exemptions may be allowed.

IDNR, Polk County, and Linn County are providing an amnesty period for completing required registrations, notifications, and/or construction permit applications for engines. Facilities have until April 23, 2014 to comply with all submittal requirements without facing any enforcement actions, including penalties, for failure to submit notifications or obtain permits. This amnesty period does not include violations of the RICE NESHAP or Prevention of Significant Deterioration permitting requirements. Refer to the IDNR website for more information.
