The rule AQ380, "Project Emissions Accounting and Offset Requirements in Specified Parishes," was originally proposed on September 20, 2018 to amend LAC 33:III.504 - Nonattainment New Source Review (NNSR) Procedures and Offset Requirements in Specified Parishes. On March 20, 2019, the LDEQ proposed substantive changes (1903Pot1) to the September 20, 2018 proposed rule to address comments received during the public comment period. On June 20, 2019, the LDEQ finalized the rule with the substantive changes (AQ380S).
The final rule incorporates four main items:
- Removes phrases from LAC 33.III.504 that explicitly preclude emissions decreases associated with a proposed project from being considered in determining whether the project results in a significant emissions increase;
- Deletes obsolete language from Footnote 4 of Table 1 in LAC 33.III.504;
- Removes Livingston Parish from the list of parishes in which offsets for certain new stationary sources and modifications are required under LAC 33.III.504; and
- Clarifies the status of creditable emission reductions from sources located in Livingston Parish in LAC 33:III.504.M.6.
