On January 20, 2019, the Louisiana Department of Environmental Quality (LDEQ) published proposed revisions to the Risk Evaluation/Corrective Action Program (RECAP). After the public hearing on March 1, 2019, LDEQ announced the withdrawal of the proposed revisions to allow LDEQ to further engage stakeholders and conduct additional outreach.
The RECAP regulation (LAC 33:I.1307) is the primary statutory mandate for remediation activities in Louisiana. The document establishes minimum remediation standards for present and past uncontrolled constituent releases.
No date was given for when the draft rule or a rewrite of the rule will again be considered.
