As discussed in our August newsletter, on July 10, 2010, the combustion (emissions) source exemption was removed from the NC Division of Air Quality (DAQ) air toxics regulations.  In many cases, emissions from new and modified combustion sources must be evaluated to determine whether air toxics permitting, including air dispersion modeling, is required.

On February 8, 2011, the DAQ issued guidance in the form of a "flow chart" intended to clarify the applicability of the air toxics regulations as they relate to new and modified combustion sources. This guidance can be found at http://daq.state.nc.us/permits/memos/toxics_flowchart_02082011.pdf.
