On May 5, 2018, the Texas Commission of Environmental Quality (TCEQ) approved the proposal of HB 4181: Update to Applicable Requirements for New Source Review and Operating Permits which provides an option for the TCEQ to use an electronic method of communication to send renewal notices for New Source Review (NSR) permits and also allows the TCEQ to send notice of a proposed final action on a Federal Operating Permit (FOP) by electronic communication.
To implement these updates, this rulemaking would amend Chapter 116, Subchapter D, §116.310 to provide for electronic NSR permit renewal notices, as well as amend Chapter 122, Subchapter D, §122.345 to provide for electronic FOP proposed final action notices. Additionally, this proposed rule would also amend other specific sections, which are not required by federal or state statue, within Chapters 116 and 122 to address recently promulgated federal provisions; reflect current permitting processes; and clarify requirements. A detailed list of these additional proposed changes can be found in section C of the TCEQ's memo, which was released on April 20, 2018.
There will be a public hearing held on June 22, 2018, and comments are due no later than June 26, 2018. Comments may be submitted via eComments beginning May 25, 2018.
