The Utah Air Quality Board held a working lunch meeting related to UDAQ's approach to enforcement and its penalty policy. This lunch meeting was a follow-up to the September 2018 AQB meeting, where the board had to vote on an enforcement case with a penalty in excess of $25,000, in accordance with Utah Air Conservation Act 19-2-104 (3)(b)(i).

UDAQ presented an outline of enforcement including but not limited to the following:

  • Inspection Process and Resources;
  • Inspection Targeting;
  • Compliance Advisory and Novice of Violation;
  • Penalties;
  • Repeat Violations;
  • Powers of the Air Quality Board; and
  • Utah Administrative Code - Enforcement.

Trinity will continue to follow this issue closely and how it may potentially change the approach on how enforcement is conducted. Stay tunes on how or if these changes will impact your business.
