DEQ Publishes Proposed Rule Establishing a State CO2 Budget Trading Program



On January 8, 2018 the Virginia Department of Environmental Quality (DEQ) published the Regulation for Emissions Trading (9VAC5-140) in the Virginia Register of Regulations. The comment period runs from January 8th, 2018 - April 9th, 2018. The rule would establish a declining cap on carbon emissions, an allowance that will be issued for each ton of carbon emitted by an electricity generating facility, and a consignment auction for determining the cost of allowances. Hearings are scheduled for March 7, 8, 12, 14, 15, and 19, 2018, in Abingdon, Roanoke, Virginia Beach, Harrisonburg, Woodbridge, and Richmond, respectively. Comments are due April 9, 2018.
