DEQ Releases Draft Power Plant CO2 Trading Rule, Hearing November 16



On the evening of the gubernatorial election, DEQ released a draft power plant trading rule via the posted agenda and minibook for the upcoming Air Pollution Control Board (APCB) meeting to be held at 10:00 am on November 16. Development of the draft rule was initiated by an executive directive issued by Governor McAuliffe, and the draft rule has been developed consistent with that directive. The rule objective is to implement a declining cap on carbon emissions from power generation, and the proposed mechanism is via joining an existing carbon dioxide trading program comprised of mainly Northeast states, the Regional Greenhouse Gas Initiative (RGGI). DEQ is requesting that the APCB approve of formally proposing the rule in the Register of Regulations and opening a public comment period.
