With the Part 2 deadline fast approaching, the Wisconsin Department of Natural Resources (WDNR) sent out an update to their previous emails on March 6, 2009. In their latest email, Wisconsin still encourages the submission of Part 2 applications, but acknowledges that the EPA has not provided any guidance on the implementation on the 112(j) MACT Hammer process. The WDNR expects that the US EPA may request additional emission testing data to further establish emission standards for Boiler MACT, anticipating the proposed new rule by August 2009. While some sources have already submitted Part 2 applications, others have requested an extension. The WDNR is now stating that sources may request an extension in writing (hard copy or email) as long as the following conditions are met:
- Request extension no later than September 24, 2009
- Provide justification for why they are unable to meet the March 28, 2009 application deadline.
Sources which have already submitted Part 2 applications may withdraw or modify their submissions in addition to requesting an extension.
As a reminder, note that the application is a "Combined Part 1 and 2" MACT Hammer Application; Part 1, pages 1-2, was due January 27, 2009 while Part 2, pages 3-4, is due on March 28, 2009 unless an extension is granted.
