As a result of the recently issued 2009 Executive Budget Bill AB-75, state operation permit holders could see a relaxation of permit terms. The current law requires the DNR to specify a term of not more than five years for most types of operation permits - state and Part 70/Title V permits. The new bill would authorize the WDNR to specify a longer term for state operation permits (i.e., longer than five years, potentially an unlimited term).
Other potential impacts to the air quality sector from this bill include:
- Revision to state operation permit annual fees (departure from $/ton fees)
- Removal of $300 annual fee for specific sources with low emissions which do not require an operation permit
- Increase to maximum fees for inspecting nonresidential asbestos demolition and renovation projects
